This document governs access to and use of foliclab.com (the "Site"), owned by Folicare S.L., and sets out the legal terms applicable to browsing, interacting with and using its content and features. The purchase of products is governed by the Purchase Terms, which form part of the contractual framework and take precedence over this Notice in matters relating to contracting.

2. Scope and Application

This Notice governs access, browsing and use of the Site by users located in Spain/EU. If you access from other countries, you are responsible for complying with applicable local regulations. The reference language is Spanish.

3. Acceptance and Amendments

Accessing and using the Site implies acceptance of these Terms. Folicare S.L. may amend them when necessary (due to regulatory, technical or business changes). Amendments will apply from the date of publication on the Site.

4. Rules of Use

You agree to use the Site in accordance with the law, good faith and these Terms, and not to use it for unlawful or harmful purposes. In particular, the following are prohibited: introducing malware; scraping or systematic extraction of content or databases; reverse engineering or circumventing security measures; using the Folic Lab brand in a way that causes confusion or unfair advantage; framing or mirroring without express prior written permission.

5. Intellectual and Industrial Property (brand, designs, content)

Ownership: All intellectual and industrial property rights over the Site and its content belong to Folicare S.L. or third-party licensors. This includes the Folic, Folic Lab and Folicare brands and other distinctive signs; designs (packaging, trade dress and commercial presentations), logos, slogans, texts, images, photographs, videos, graphics, icons, interfaces, layouts and templates, product listings, manuals, collections and databases, as well as the Site's software and code.

• Limited licence: a limited, non-exclusive, revocable and non-sublicensable licence is granted to access and use the Site solely for personal and non-commercial purposes. Copying, reproducing, distributing, publicly communicating, transforming, extracting or making available the content beyond what is necessary for private viewing or sharing genuine links to the Site is not authorised.
• Prohibitions: reproducing designs, packaging or graphic elements for own or third-party products; registering or using domains, accounts or metatags containing Folic Lab brands or distinctive signs; using or altering logos and visual identity elements without consent; creating derivative works or training models with Site materials for commercial purposes without prior licence.
• User-generated content (UGC): when you tag us or submit reviews, photos or videos, you grant us a non-exclusive, worldwide, royalty-free and revocable licence to reproduce, communicate and adapt them for marketing purposes (Site, newsletters or social media), crediting you by name/username where appropriate. You may revoke it at any time by writing to soporte@foliclab.com, without retroactive effect on uses already made.
• Infringement notices: if any content infringes rights, send notice to soporte@foliclab.com with identification and proof of representation, description of the work/sign, exact URL, good faith declaration and contact details.

6. External Links

The Site may contain links to third-party sites. Folicare S.L. does not control or accept responsibility for their content or operation. The inclusion of links does not imply association or endorsement. Linking to https://foliclab.com from pages that comply with the law is permitted, without framing or reproducing content; use "Folic Lab" as link text, without logos or distinctive signs, without authorisation.

7. Liability and Warranties

The Site is provided "as is" and "as available". No guarantee is given as to the absence of interruptions, errors or vulnerabilities. Folicare S.L. shall not be liable for damages arising from misuse, third-party technical issues or decisions taken without following product usage instructions. Nothing limits liabilities that cannot be excluded under consumer law.

8. Product Information and Health Disclaimer

Folic Lab products are cosmetics and are not intended to diagnose, treat or prevent any disease. Follow the instructions on the packaging and consult a healthcare professional in case of doubt or adverse reaction.

9. Purchase of Products

The purchase of products is governed by the "Purchase Terms". In the event of conflict with this Notice, the Purchase Terms shall prevail in contractual matters.

10. Reviews and Ratings

You may leave truthful and respectful reviews. Folicare S.L. may moderate or remove content that is defamatory, unlawful, misleading, covertly commercial or in breach of these Terms. Impersonation or manipulation of ratings is prohibited.

11. Personal Data Protection

The processing of data is described in the Privacy Policy. The use of cookies is governed by the Cookie Policy.

12. Site Security

We apply reasonable technical and organisational measures. We recommend keeping devices up to date and not sharing credentials. Folicare S.L. will never ask for passwords by email.

13. Promotions, Vouchers and Competitions

These will be governed by specific terms. Unless otherwise stated, they are non-cumulative and have limited validity.

14. Severability and Non-Waiver

The invalidity of any clause does not affect the remainder. Failure to enforce compliance does not constitute a waiver.

15. Governing Law and Jurisdiction

Spanish law applies. For disputes, without prejudice to mandatory consumer rights, you may opt for the courts of your place of residence or those of Madrid (Spain).
